Slovenia has outlawed unsolicited commercial mail since the beginning of 2003.

The relevant law is the Act on Amending the Consumers Protection Act (Zakon o spremembah in dopolnitvah Zakona o varstvu potrosnikov - ZVPot-A) - Official Gazette 110-5391/2002 (December 18, 2002). It amends the Consumers Protection Act (Zakon o varstvu potrosnikov - ZVPot) - Official Gazette 20-815/1998.

Article 45.a

A company may use automated dialing system, fax machine or e-mail only with approval of individual consumer, to whom the message is sent.

If consumer in any contact, made by means of communications that use personal messages, states that he doesn't want to receive any more messages, the company may not send him any messages offering a deal for purchase of any goods or services.

Article 77

An individual who commits a misdemeanor shall be fined by at least 1 million SIT (1 EUR = approx 230 SIT) and a company shall be fined by at least 3 million SIT, if:

  1. uses automated dialing system, fax machine, or e-mail, without prior consent of the consumer, to whom the message is sent (paragraph one of article 45.a)
  2. sends messages, offering a deal for purchase of any goods or services, although the consumer has stated he didn't want to receive them any further (paragraph three of article 45.a)
